GENERAL TERMS AND CONDITIONS

  1. Hevelia Swim & Spa (hereinafter referred to as the Facility) is designed for recreation and relaxation. It consists of a swimming pool zone and a SPA zone (comprising sauna, bath, meditation, and massage treatment room areas). A detailed set of terms and conditions is provided for the use of each individual SPA zone. Additionally, the swimming pool zone is subject to the terms and conditions of the whirlpool bath area.
  2. The Facility is open daily from 8:00 AM to 10:00 PM.
  3. Facility employees are entitled to the rights of a manager of a designated water area, as defined by relevant legal provisions. Individuals within the Facility are obliged to comply with the instructions and orders of the lifeguards on duty and other Facility employees.
  4. The Facility is equipped with a video monitoring system with recording capabilities. Recordings from cameras may serve as grounds for holding users accountable if they fail to comply with these terms and conditions, the SPA zone terms and conditions, the whirlpool bath terms and conditions, and instructions. The Facility Management ensures that monitoring is conducted in a manner that does not infringe upon the personal rights or dignity of users.
  5. Individuals in the swimming pool zone are obliged to exercise due diligence to protect their own life and health, as well as that of others, and in particular:
    • to familiarize themselves with and adhere to the terms and conditions for using the swimming pool zone and its installed equipment, including the whirlpool bath terms and conditions,
    • to comply with information, mandatory, and prohibitory signs placed within the Facility, particularly in the swimming pool zone,
    • to comply with the instructions and audible signals of lifeguards and Facility employees, as well as announcements made via loudspeakers, especially alarm signals,
    • to familiarize themselves with and adapt their activities to their own skills, general fitness, and health condition,
    • to use equipment appropriate for the type of activity undertaken, in good technical condition, and in accordance with its intended purpose and usage rules,
    • to immediately inform lifeguards or Facility employees of any accident, injury, or other event that may affect their own safety or the safety of others.
  6. Children under 13 years of age may only be present in the Facility under the constant supervision of adults. These adults bear full responsibility for the children entrusted to their care and are liable for any damages caused by them.
  7. The following audible signals are in effect within the Facility:
    • a series of audible signals – ALARM – a call for all users to immediately leave the pool basin and comply with further instructions from lifeguards or Facility Management,
    • a long audible signal – end of activities – immediate exit from the water,
    • a short audible signal – a command to pay attention to announcements from the lifeguard and Facility staff,
  8. The entire swimming pool area is designated for swimmers, with a depth ranging from 1.4 m to 1.6 m. Users should adapt their activities to their own swimming abilities.
  9. Actual depths in individual zones are indicated by pictograms on the pool basin walls or nearby.
  10. Entry to the Facility is granted based on a transponder from the Electronic Customer Service System, obtained after purchasing a service in accordance with the Facility’s current price list. The transponder must be worn on the wrist.
  11. The transponder authorizes the use of equipment and zones within the Facility for which it was purchased and must be settled and returned at the cash desk upon exit.
  12. Receiving the transponder signifies that the user undertakes to comply with all terms and conditions and other regulations issued to ensure safety within the Facility, and the client confirms having read these General Terms and Conditions, the SPA Zone Terms and Conditions, and the Whirlpool Bath Terms and Conditions.
  13. The duration of stay and associated fees are calculated from the moment the transponder is activated at the entrance cash desk in the Facility reception until the transponder’s memory is read at the exit cash desk in the Facility reception.
  14. Full payment for the use of equipment, any extended stay at the Facility, and all additional paid goods and services must be settled upon leaving the Facility.
  15. The Facility Management may temporarily restrict entry to the swimming pool zone due to exceeding the maximum number of users.
  16. Users will be admitted to the Facility no later than 60 minutes before its closing time.
  17. Before entering the changing rooms, outdoor footwear must be changed to pool footwear (barefoot walking is permitted). After swimming and using the Facility’s attractions and changing, pool footwear is changed back to outdoor footwear after leaving the changing rooms.
  18. Changing of outer clothing takes place in the changing rooms and cubicles.
  19. Persons using the Facility are obliged to place and store clothing, bags, and other items brought into the Facility in designated lockers in the changing rooms. Valuables should be deposited at the reception before entering the changing rooms.
  20. The Facility Management is not responsible for items lost, abandoned, or left unattended within the Facility.
  21. Before leaving the changing rooms for individual zones of the Facility, users should check that their belongings have been placed in a locker with a number corresponding to the transponder number, and that the locker has been properly closed. The Facility Management is not responsible for items left in incorrect lockers (i.e., with a number not corresponding to the transponder number), open or improperly closed lockers, or for money and valuables.
  22. Before entering the swimming pool zone, every person is obliged to thoroughly wash their entire body under the shower using appropriate cosmetics or cleansing agents (also after using the toilet) and to disinfect their feet. A foot disinfection device is located at the entrance to the swimming pool zone.
  23. Only clean swimwear, meeting hygienic and aesthetic requirements, without zippers or other metal or plastic inserts that could pose a threat to the health or safety of the user or other users, or cause damage to Facility equipment, is permitted in the swimming pool zone:
    1. for women, a one-piece or two-piece swimsuit, close-fitting to the body,
    2. for men, swimming trunks with a maximum length to mid-thigh
  24. Children under 3 years of age using the swimming pool zone must wear disposable swim diapers.
  25. Entry to the Facility is prohibited for individuals with medical contraindications, those suffering from diseases that may be dangerous to other users, those with wounds and skin diseases, and those with plasters, bandages, or plaster casts.
  26. Disabled persons using the Facility and moving in wheelchairs are obliged to use the changing room prepared for them and to have additional assistance when using the swimming pool zone, due to level differences.
  27. Lifeguards are individuals wearing red attire with the inscription ‘RATOWNIK’ (LIFESAVER).
  28. All pool basins in the swimming pool zone are under the supervision of the rescue service. This does not relieve guardians of children under 13 years of age from direct and constant supervision over the children.
  29. Areas of the Facility may be temporarily closed for operation, indicated by appropriate signage, and their use is prohibited during this time.
  30. To ensure hygiene and safety, individuals within the Facility are prohibited from:
    • entering the water against the prohibition of lifeguards, in the absence of a rescue service on duty, and during rescue operations,
    • being in the Facility while intoxicated or under the influence of narcotics,
    • bringing in and consuming alcoholic beverages or narcotics,
    • using swimwear and items that are visibly dirty or that may react chemically with water,
    • diving or jumping into the water without permission or against the lifeguard’s prohibition,
    • bringing in glass containers, cans, sharp tools, weapons, or other dangerous objects,
    • running, pushing, throwing into the water, shouting, or behaving in a manner that endangers one’s own safety or the safety of other Facility users,
    • initiating false alarms,
    • throwing any objects into the water in the swimming pool zone,
    • performing gymnastic exercises on entrance ladders and handrails,
    • entering and exiting pools outside designated areas,
    • entering lifeguard stations or using rescue equipment,
    • littering or polluting Facility premises and the swimming pool zone,
    • using soap and chemical agents in the swimming pool zone,
    • damaging Facility equipment and furnishings,
    • moving movable equipment without the consent of lifeguards or Facility staff,
    • using mobile phones or other image recording devices in changing rooms, showers, and the swimming pool zone; in particular, taking photos and video recording is prohibited,
    • bringing in musical instruments or playing devices,
    • smoking tobacco and e-cigarettes,
    • chewing gum or consuming food,
    • leaving pool flip-flops in communication areas,
    • bringing in animals, vehicles (rollerblades, bicycles, skateboards, strollers), or items that obstruct communication within the Facility,
    • relieving oneself outside designated toilets.
  31. Wearing glasses and contact lenses is at the user’s own risk. If wearing prescription glasses in the swimming pool zone, these glasses must be secured in a way that prevents them from falling off.
  32. The use of hair dryers and other electrical equipment should only take place in the changing rooms.
  33. Bringing in and using one’s own sports and recreational equipment within the Facility is prohibited without the express consent of Facility staff.
  34. Individuals present in the Facility who violate public order, good customs, including using vulgar language, posing a threat to other persons in the Facility, as well as individuals who do not comply with the provisions of these terms and conditions and the recommendations of security services or Facility employees, may be removed from the Facility, regardless of any potential criminal or civil proceedings.
  35. Individuals who destroy or damage Facility equipment or devices bear full financial responsibility for the damages caused.
  36. Items found within the Facility should be handed over to staff. Staff will return found items after identification by the owner within 30 days from the date they were left.
  37. Any commercial activity, including but not limited to sales, marketing, and service activities, distributing leaflets, selling goods, offering and performing services, and private swimming lessons for remuneration, is prohibited within the Facility without the permission of the Facility Management.
  38. Comments and suggestions should be reported to the Manager or Facility Management.
  39. Other matters not covered by these Terms and Conditions are governed by general regulations and the Facility Management.
  40. The Facility Management is not responsible for any incidents resulting from non-compliance with the provisions of these terms and conditions.

SPA ZONE TERMS AND CONDITIONS

  1. The SPA Zone is part of the Hevelia Swim & Spa Facility. The SPA Zone includes: a sauna area, a bath area, a meditation area, and treatment rooms, where the provisions of the Facility’s General Terms and Conditions and these SPA Zone Terms and Conditions apply.
  2. The SPA Zone is open daily from 8:00 AM to 10:00 PM; however, in the sauna area, some saunas are available from 8:00 AM to 3:00 PM, and all saunas (i.e., two dry saunas and two steam saunas) are available from 3:00 PM to 10:00 PM.
  3. The SPA Zone is accessible to individuals aged 16+. Children under 13 years of age may only be present in the Facility under the constant supervision of parents or other adults; unaccompanied children under 13 are not permitted in the SPA Zone. These individuals bear full responsibility for the children entrusted to their care and are liable for any damages caused by them within the Facility.
  4. In the event of organized events, including those with children under 13, the restrictions resulting from the following terms and conditions may be temporarily waived for the duration of the event.
  5. Individual zones within the Facility may be temporarily closed for organized classes or other events.
  6. Entry to the SPA zone is granted based on a transponder from the Electronic Customer Service System, obtained after purchasing a service in accordance with the Facility’s current price list. The transponder must be attached to the wrist and is subject to settlement and return at the cash desk upon exiting the Facility.
  7. Receiving the transponder signifies that the user confirms having read and undertakes to comply with all terms and conditions and other regulations issued to ensure comfortable use and safety within the Facility.
  8. The duration of stay and associated fees are calculated from the moment the transponder is activated at the entrance cash desk until the transponder’s memory is read at the exit cash desk.
  9. Full payment for any extended stay at the Facility, additional services purchased, or goods registered on the transponder in accordance with the current price list must be settled upon leaving the Facility.
  10. Individuals using the SPA zone should place and store clothing, bags, and other items brought into the Facility in designated lockers marked with a number corresponding to the transponder number. Valuables should be deposited at the reception’s deposit box before entering the changing rooms.
  11. The Facility Management is not responsible for items left unattended in the SPA Zone. In the case of lost or found items, their storage will not exceed 30 days.
  12. Before leaving the changing rooms, users should check that the locker has been closed. The Facility Management is not responsible for items left in open or improperly closed lockers, money, or valuables.
  13. Comments and suggestions should be reported at the Facility reception or via email to: recepcja@hevelia.spa.
  14. Other matters not covered by these Terms and Conditions are governed by general regulations and the Facility Management.
  15. Hevelia Swim & Spa Sp. z o.o. is not responsible for any incidents resulting from non-compliance with these terms and conditions.

REGULATIONS CONCERNING THE SAUNA ZONE:

  1. Before entering the sauna zone premises, please familiarize yourself with the provisions of the following terms and conditions. When using the sauna zone, it is imperative to comply with the terms and conditions, equipment usage instructions, and orders and information provided by saunamistrzs and Facility employees.
  2. The Facility Management may temporarily restrict entry to the sauna zone premises due to exceeding the maximum number of users.
  3. Users will be admitted to the sauna zone premises no later than 60 minutes before their closing time. Users are obliged to leave the sauna zone in time to allow for its closure at the designated hour and to exit the Facility at its closing time.
  4. The sauna zone includes: a relaxation room, two dry saunas (BIO and Finnish), and two steam saunas (including a Hammam), as well as an icefall, showers, and a suspended bucket with cold water.
  5. Before entering the sauna zone, every person is obliged to thoroughly wash their entire body under the shower (also after using the toilet) and dry themselves completely.
  6. The sauna cabin area is a nudity zone, where it is forbidden to enter and use its attractions in swimwear, sportswear, or underwear, as well as to use towels made of synthetic fibers (e.g., polyester, microfiber). In saunas, it is permissible to cover the body with a towel, kilt, pareo, pashtemal, or other covering made of natural fibers. In dry saunas, one should sit on a towel and keep their feet on it. The towel should be spread so that no part of the body touches the wooden elements of the sauna. Steam saunas should be used naked, after thoroughly rinsing the seat and the stone table in the Hammam before and after each use.
  7. We encourage you to use the sauna zone attractions in accordance with the principles of proper sauna etiquette (detailed information is placed at the entrance to each sauna and available from saunamistrzs and Facility employees).
  8. The Facility Management is not responsible for the health consequences of using the sauna zone attractions.
  9. Only healthy individuals or those whose ailments do not constitute contraindications to treatments may use the sauna zone attractions.
  10. It is not recommended to use the sauna zone attractions for individuals:
    • with heart conditions, hypertension, and vascular diseases,
    • with thyroid conditions, claustrophobia, epilepsy, acute rheumatic conditions, cancers, thrombosis, acute infections, and asthmatic conditions,
    • dehydrated or with a fever,
    • pregnant women,
    • tired, weakened, or in a state of intoxication.
  11. Using the sauna zone attractions is at the users’ own risk. Individuals with unstable health conditions should use the attractions with particular caution and after consulting their doctor.
  12. An alarm button is located in the sauna cabin to call for help in case of an accident.
  13. Wearing glasses and contact lenses is at the user’s own risk. If wearing prescription glasses in the sauna zone premises, these glasses must be secured in a way that prevents them from falling off.
  14. Metal objects (chains, earrings, wedding rings, watches, frames) must be removed before entering the sauna zone.
  15. Within the sauna zone, it is prohibited to:
    • a) enter in clothing or footwear other than pool footwear,
    • b) bring in any type of bags and backpacks or other accessories in which personal belongings may be stored (e.g., plastic bags, sacks); only completely transparent bags are permitted,
    • c) make calls or use mobile phones in any mode other than silent, or use any devices for recording images or sound,
    • d) run, make noise, or engage in loud conversations that disturb the peace and intimacy of other users,
    • e) climb on tables, counters, and structural elements not intended for this purpose,
    • f) touch or tamper with technical equipment, pour water on sauna heaters, use one’s own oils and fragrances, cosmetics, peels, etc.,
    • g) bring into sauna rooms any containers, especially glass ones, or other items that could create a hazardous situation for other users,
    • h) bring in and consume alcohol, alcoholic beverages, or narcotics brought into the Facility,
    • i) smoke tobacco and e-cigarettes,
    • j) bring in and consume food,
    • k) destroy or damage equipment, decorations, and live plants,
    • l) engage in indecent behavior or behavior socially deemed inappropriate or offensive.
  16. Individuals present in the sauna zone who violate public order, good customs, including using vulgar language, posing a threat to other persons in the Facility, as well as individuals who do not comply with the provisions of these terms and conditions and the recommendations of saunamistrzs and other Facility employees, may be removed from the Facility, regardless of any potential civil proceedings.
  17. Individuals who destroy or damage Facility equipment or devices bear full financial responsibility for the damages caused.

REGULATIONS CONCERNING THE BATH ZONE:

  1. It is not recommended to use the bath zone attractions for individuals:
    • with visible skin damage and skin diseases,
    • with hypertension and heart conditions, respiratory system diseases, neurological diseases, and gastrointestinal problems,
    • pregnant women between 16 and 40 weeks of gestation,
    • with any contraindications for bathing.
  2. Using the bath zone attractions is at the users’ own risk. Individuals with unstable health conditions should use the attractions with particular caution and after consulting their doctor.
  3. Before entering the bath zone, every person is obliged to thoroughly wash their entire body under the shower.
  4. The bath zone is an area with restricted access; during treatments, users are present at their own risk and should behave reasonably and responsibly. In case of needing assistance, Facility employees should be verbally called.
  5. Careful entry into and exit from the baths is recommended.
  6. It is prohibited to spill water, submerge one’s head and face, make noise, bring in and consume food, alcoholic beverages, or narcotics, or engage in indecent behavior.
  7. Supervision over treatments in the bath zone is provided by saunamistrzs or other Facility employees, whose instructions all users are obliged to follow.
  8. In the event of an accident caused by non-compliance with the bath zone regulations or using a treatment despite existing contraindications for bathing, the user bears all responsibility for its consequences.
  9. Individuals present in the SPA zone who violate public order, good customs, including using vulgar language, posing a threat to other persons in the Facility, as well as individuals who do not comply with the provisions of these terms and conditions and the recommendations of Facility employees, may be removed from the Facility.

REGULATIONS CONCERNING THE MEDITATION ZONE:

  1. Before entering the meditation zone, please ensure that a meditation session is not in progress or that the zone is not being used for group classes or events.
  2. Silence is required in the meditation zone.
  3. The use of zafu and zabuton meditation mats is permitted provided that towels are used to sit on them.
  4. Indecent behavior or behavior socially deemed inappropriate or offensive is prohibited. Individuals who violate public order, good customs, as well as individuals who do not comply with the provisions of these terms and conditions and the recommendations of Facility employees, may be removed from the Facility.

REGULATIONS CONCERNING THE TREATMENT ROOMS ZONE:

  1. Clients using treatments are requested to arrive punctually, preferably 15 minutes before the scheduled treatment time. A Facility employee will escort the client to the treatment rooms zone, indicating the appropriate locker for belongings and a changing area. Silence is required in the waiting room, and movement within the Facility without staff assistance is prohibited.
  2. Before undergoing treatments, the Client is obliged to complete a health questionnaire and inform about any contraindications for the treatment. Massages are not recommended for pregnant women.
  3. The Client bears the risk of withholding information about contraindications for the treatment. The therapist or other employee performing the treatment may refuse to perform the treatment or interrupt its performance if justified doubts arise regarding the Client’s health condition, fitness, and any contraindications for performing or continuing the treatment. In such a case, the treatment fee is not refundable to the Client.
  4. The Facility Management is not responsible for the health consequences of using treatments of inappropriate intensity or if the Client has contraindications for the treatment.
  5. Individuals present in the treatment rooms zone are obliged to refrain from touching and damaging images, decorations, live plants, and product displays.
  6. Clients who damage property or act in any other way contrary to good customs, pose a threat to other persons in the Facility, as well as individuals who do not comply with the provisions of these terms and conditions and the recommendations of Facility employees, may be removed from the Facility.

WHIRLPOOL BATH TERMS AND CONDITIONS

  1. The whirlpool bath is an integral part of the swimming pool zone, and its use is subject to the provisions of the Facility’s general terms and conditions, as well as these additional terms and conditions.
  2. Every person using the whirlpool bath is obliged to familiarize themselves with the terms and conditions and information boards.
  3. Using the whirlpool bath is at the user’s own risk.
  4. It is not recommended to use the whirlpool bath attractions for individuals:
    • with visible skin damage and skin diseases,
    • with hypertension and heart conditions, respiratory system diseases, neurological diseases, and gastrointestinal problems,
    • pregnant women between 16 and 40 weeks of gestation.
  5. Individuals with circulatory, respiratory, neurological, and gastrointestinal dysfunctions should use the whirlpool bath with particular caution and after medical consultation.
  6. Before entering the whirlpool bath, every person is obliged to thoroughly wash their entire body under the shower.
  7. Children under 13 years of age may use the whirlpool bath only under the constant supervision of parents or adult guardians.
  8. Particular caution should be exercised when entering the whirlpool bath.
  9. The person exiting the whirlpool bath has priority in communication.
  10. A maximum of 12 people may be in the whirlpool bath at one time.
  11. It is prohibited to create situations that endanger one’s own safety, the safety of other whirlpool bath and swimming pool users, or that may cause an accident, and in particular:
    • entering and exiting the whirlpool bath in any way other than via the steps,
    • using the whirlpool bath when the aeration system is turned off,
    • using the whirlpool bath if access is closed by a chain, safety rope, or in any other visible way,
    • pushing people into the whirlpool bath,
    • bringing any objects into the whirlpool bath,
    • being in the whirlpool bath in a standing position,
    • submerging one’s head and face,
    • spilling water from the whirlpool bath,
    • sitting on the edge of the whirlpool bath basin.
  12. Supervision over compliance with these terms and conditions is provided by lifeguards and Facility employees. All persons using the whirlpool bath are obliged to strictly follow their instructions.
  13. In the event of an accident caused by non-compliance with the whirlpool bath terms and conditions, the user bears all responsibility.
  14. All persons violating public order or the provisions of these terms and conditions will be removed from the whirlpool bath, as well as from the Facility.

Sale and Provision of Services Paid with a Prepaid Card

§ 1

  1. The reusable prepaid card (hereinafter also referred to as the “Card”) is issued in the form of a plastic card equipped with a transponder and bearing a unique number.
  2. A prepaid card with a unique code generated by Hevelia Swim & Spa is issued as a result of the intention to purchase goods or the Client placing an order for the provision of a service by Hevelia Swim & Spa Sp. z o.o. The condition for issuing a prepaid card is its activation upon topping up with a minimum amount of PLN 50, payable in cash at the cash desk or non-cash to the Issuer’s account, and acceptance of the terms and conditions.
  3. The Card’s terms and conditions are available at the issuer’s registered office, i.e., Hevelia Swim & Spa, and on the website www.hevelia.spa.
  4. Prepaid cards are continuously available for sale at a price of PLN 6 gross and can be activated and used to pay for goods or any service currently provided at the time of payment, at a price consistent with the current price list.
  5. The Card’s validity period expires 6 months from the date of its activation or last top-up. Failure to top up for a period longer than 6 months means that the Card’s validity period cannot be extended.
  6. By activating the prepaid card, the Client declares and confirms that they have read these Terms and Conditions, understand their content, have no objections, and undertake to comply with them.
  7. The Client and any subsequent user of the prepaid card are obliged to inform the next user to whom they transfer the Card about the content of these Terms and Conditions.
  8. The Card is not refundable or exchangeable for cash.
  9. If the funds on the Card are not used within its validity period as described above, the entire balance of funds recorded on the Card shall revert to Hevelia Swim & Spa.

§ 2

  1. Once activated, the prepaid card serves as the equivalent of cash, enabling the purchase of goods or services from the commercial offer and price list current on the date of payment using the Card. When the Card is used for the purchase of goods and services, its balance will be reduced by the value of the purchased goods and services.
  2. Cash funds equal to the current Card balance are not subject to interest. The prepaid card is not an electronic payment instrument, an electronic money instrument, or a bank payment card.
  3. The Card can be topped up multiple times within its validity period. The Client and any user of the card may use the Card repeatedly until the balance of funds on the Card is exhausted. If the full price of a service or goods purchased using the Card is not covered, it is necessary to top up the Card to at least the full price of the goods or service before use.
  4. The Card user may, at any time until the Card’s expiration date, obtain information about the Card’s balance.
  5. The Issuer has the right to refuse to process a transaction using the Card if:
    a) the presented card is not authentic,
    b) there are insufficient funds on the prepaid card,
    c) the Card’s validity period has expired,
    d) the Card has not been activated,
    e) the Card is damaged to an extent that prevents reading the data stored on the Card.

§ 3

  1. The Card Issuer, Hevelia Swim & Spa, is not responsible for prepaid cards that, after their issuance and activation, have been lost or damaged by any user.
  2. The Issuer does not allow the Client or any user of the Card to report a reservation or request to block the Card.
  3. In the event of damage, destruction, or loss of a prepaid card, its user has no claims against Hevelia Swim & Spa.
  4. The Buyer bears the fee for delivering the Card in connection with its issuance.
  5. In the event of suspension of prepaid card issuance, Hevelia Swim & Spa undertakes to accept them for 6 months from the date of public announcement on the website www.hevelia.spa regarding the suspension of prepaid card issuance or non-acceptance for transactions using these cards.

§ 4

  1. All complaints related to prepaid cards will be processed by Hevelia Swim & Spa in writing within 30 days from the date of submission of a written complaint by the Card user. The Client should submit the complaint directly at Hevelia Swim & Spa, ul. Kilińskiego 7a in Gdańsk, or via email to: recepcja@hevelia.spa.
  2. Complaints regarding purchased goods or services rendered may be submitted under general rules to the addresses above.

§ 5

  1. The Terms and Conditions may be amended at any time without cause, provided that their content comes into effect upon publication on the Card Issuer’s website.
  2. The current version of the Terms and Conditions is always available on the website www.hevelia.spa and at the point of purchase of the prepaid card.

Sale and Redemption of Gift Vouchers

§ 1

  1. The gift voucher is issued in the form of an elegant invitation packaged in an envelope.
  2. The gift voucher has a unique code generated by Hevelia Swim & Spa as a result of the Client placing an order for the provision of a service by Hevelia Swim & Spa Sp. z o.o. The condition for issuing a gift voucher is prior full payment for the service offered by Hevelia Swim & Spa and acceptance of these terms and conditions.
  3. Gift vouchers are continuously available for sale and may cover any services currently provided, expressed as an amount consistent with the price list.
  4. The validity period of the gift voucher is 3 months from the date of purchase. The validity date of the gift voucher cannot be extended.
  5. At the time of purchasing a service offered by Hevelia Swim & Spa, the Client declares whether they wish to receive a gift voucher.
  6. If the gift voucher is not used within its validity period, the Client is not entitled to use the purchased service to which the gift voucher applies after its validity period, unless the inability to provide the service results solely from reasons attributable to Hevelia Swim & Spa, and the Client attempted to book the service before its expiration.
  7. The Client is not entitled to exchange the gift voucher for a cash payment.

§ 2

  1. A condition for using the Voucher is the Client’s reservation of the service date to which the Voucher applies.
  2. When booking an appointment with a gift voucher, please inform us that the payment method for the service will be a gift voucher.
  3. If a reservation is not canceled 24 hours before the scheduled appointment, the gift voucher will be considered redeemed.
  4. When redeeming a gift voucher, the Client provides its unique number or presents the physical gift voucher.
  5. A gift voucher cannot be used in parts. In the event of a change in service price or the application of discounts between the voucher issuance date and the service redemption date, it is not possible to refund the price difference from a gift voucher that covers an amount higher than the service value. If the service value is higher than the gift voucher value, the Client is not obliged to pay the price difference for the service.
  6. Payment with a gift voucher cannot be combined with promotions or other discounts offered by Hevelia Swim & Spa.
  7. Named gift vouchers cannot be transferred to another person.
  8. Gift vouchers for selected services cannot be exchanged for other services from the Hevelia Swim & Spa offer.

§ 3

  1. Gift Vouchers are sold directly at Hevelia Swim & Spa. They can also be purchased by placing an order via the contact form available on the website www.hevelia.spa or by email at recepcja@hevelia.spa.
  2. Payment for a Gift Voucher purchased directly at Hevelia Swim & Spa is made by the Client in cash or by payment card.
  3. For a Gift Voucher ordered online, we accept payment by bank transfer. Order acceptance and bank transfer details are confirmed by email.
  4. When paying by bank transfer, a treatment reservation can only be made after the funds have been credited to the Hevelia Swim & Spa account.
  5. The Buyer bears the cost of shipping the Gift Voucher.

§ 4

  1. Any complaints regarding the improper performance by Hevelia Swim & Spa of the obligations specified in these Regulations should be submitted by the Client directly at Hevelia Swim & Spa within 3 days of the performance of these obligations or by email at recepcja@hevelia.spa.
  2. The Client will receive information about the outcome of the complaint resolution via email.

§ 5

  1. The Administrator of the Client’s Personal Data is Hevelia Swim & Spa sp. z o.o. with its registered office in Gdańsk (80-452), ul. Jana Kilińskiego 7, NIP: 9571183719, REGON: 540748460.
  2. Personal Data is processed with appropriate security measures that meet legal requirements.
  3. Personal Data will be processed for the purposes of:
  4. a) fulfilling the Gift Voucher,
  5. c) settling and invoicing services,
  6. d) conducting complaint proceedings (if applicable),
  7. e) marketing, if the legal basis for processing is the permitted, legitimate interests of the personal data administrator – Article 6(1)(f) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”).
  8. Furthermore, Personal Data may be used for statistical purposes within the legally permissible and legitimate interest of the personal data administrator (Article 6(1)(f) GDPR).
  9. The provision of Personal Data is voluntary but necessary for the fulfillment of the Voucher.
  10. Personal Data will be stored only for the period necessary for the proper fulfillment of the above purposes, and after their completion, for the period required by obligations imposed on the data administrator by law, including (i) provisions regarding civil liability for the proper performance of obligations by the parties, and (ii) tax regulations.
  11. The Client has the right to: access their personal data, rectify it, erase it, restrict its processing, data portability, the right to object to data processing due to a specific situation or for direct marketing purposes, and also the right to withdraw consent to data processing at any time without affecting the lawfulness of processing carried out before its withdrawal.
  12. If it is deemed that a violation of personal data protection regulations has occurred, the Client has the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work, or place of the alleged infringement.
  13. The legal basis for personal data processing is: Article 6(1)(a, b), c) and f) GDPR.

§ 6

  1. The Regulations may be amended at any time, with the proviso that for Gift Vouchers purchased before the amendment, the existing provisions shall apply, unless the amendment is more favorable to the Client.
  2. The current version of the Regulations is always available on the website www.hevelia.spa and at the point of purchase of the Gift Voucher.
